- Convicted Pawan’s lawyer seeks time from court to hand over new documents, Nirbhaya’s parents objected to this

The Delhi High Court on Thursday dismissed the petition of Pawan Gupta, one of the four convicts of Nirbhaya gang rape and murder. The convict sentenced to death in the case had filed a petition on Wednesday, in which he had declared himself a minor at the time of the incident. Pawan’s lawyer AP Singh sought time from the court to hand over the new documents during the hearing, to which Nirbhaya’s parents objected.
Justice Suresh Kumar Kait sent messages to the convict’s lawyer several times, but he did not appear in court. On this, the court imposed a fine of 25 thousand rupees on them for giving a forged affidavit of the age of the accused and playing hide and seek. The court has also directed the Bar Council to take action against the lawyer.
The convict Pawan said in the plea that his ossification test (bone test) did not take place after the incident nor was he given concession under the legal provisions for minors. According to him, before the disposal of a case, the offender can be considered to be a minor.
Notice issued to the convicts for filing mercy petition
The Supreme Court upheld the death sentence on Wednesday by dismissing the reconsideration petition of Nirbhaya convict Akshay. After this, the death warrant of the convicts was heard in Patiala House Court. The court directed the Tihar Jail to issue a notice to the convicts and ask if they wanted to file a mercy petition. After this, the Tihar Jail administration gave notice to the convicts that they have 7 days to file mercy petition. The court will next hear it on 7 January. However, Akshay’s lawyer AP Singh has said to file a curative petition before the mercy petition.
6 people raped into a bus with Nirbhaya
On the night of December 16, 2012, 6 people raped a paramedical student (Nirbhaya) in a moving bus. She died in Singapore on 26 December due to several serious wounds. Pawan, Akshay, Vinay and Mukesh have been sentenced to death in the case. During the trial, the main culprit Ram Singh committed suicide by hanging himself in Tihar Jail. Another convict has been released from the correctional home in 3 years due to being a minor.
