On Friday, Delhi high court sentences expelled BJP MLA Kuldeep Singh to life imprisonment for raping a minor girl in Uttar Pradesh’s Unnao in 2017.
The court has also announced a compensation of Rs 25 lakhs to be given to the victim’s family as compensation.The court also ordered to examine any threat chances and offer the necessary protection to the victim and her family.
On Monday, the court had convicted the expelled BJP MLA and adjourned till December 20 the hearing on order for the quantum of sentence to Sengar.
The case was transferred to District judge Dharmesh Sharma from Unnao in Uttar Pradesh as per the directions of the Supreme Court. And the judge has been conducting the trial in the case regularly from August 5. The case is among the five related cases that have been transferred from Uttar Pradesh to the Capital.
The four other cases are related to framing the victims’ father in an illegal firearms case and his death in judicial custody, the conspiracy of Sengar with others in the accident case of a rape survivor and the last one is of alleged gang rape by other three survivors.
BJP expelled MLA was conducted under Section 376 (rape) of the Indian Penal Code (IPC) and Section 5 (c) and 6 of the Protection of Children from Sexual Offences (POCSO) Act, which is related to penetrative sexual assault committed against a child by a public servant.
The victims’ father was allegedly framed in a case of illegal firearms and was arrested on April 3, 2018, and dies in judicial custody on April 9, 2108.
The court is conducting a joint-trial in both the cases and has framed murder and other charges against Sengar, his brother Atul Sengar, three Ex-UP policemen and six others in the case.
The statement of all accuses has been recorded and the defense will submit its witnesses on Tuesday.
The rape survivor was allegedly kidnapped on June 11, 2017, in Unnao by three others named Naresh Tiwari, Brijesh Yadav, and Shubham Singh. The court has also framed charges against the three and the trial is yet to start in the case. The fourth related case was about the accident of rape survivor on July 28 this year. In the accident, the car was hit by the truck in which the victim was severely injured and two of her aunts died. Her family alleged wicked play by Senagr and nine others in the car crash.
The CBI has named 10 people as accused including the MLA but the probe agency mentioned it as and not murder in its charge sheet.The trial court is yet to analyze the charge sheet in the accident case.
A day after Sengar conviction on Monday, CBI has sought life imprisonment for expelled BJP MLA as according to them it was s fight of an individual against the system.The agency requested the court to give maximum punishment for the long term to the politician, prescribed under the law.
