Comments on a woman’s body structure qualify as sexually coloured remarks and constitute sexual harassment under the Indian Penal Code (IPC), according to a landmark ruling by the Kerala High Court. Justice A. Badharudeen issued this judgment while rejecting a plea by a former employee of the Kerala State Electricity Board (KSEB) to quash charges of sexual harassment filed against him by a woman colleague.

The case stems from allegations that the accused, a former KSEB employee, had been harassing the complainant since 2013. His behavior reportedly escalated in 2016-17, with him sending inappropriate and objectionable messages and making harassing voice calls. Despite lodging complaints with both the KSEB authorities and the local police, the woman alleged that the harassment continued unabated.

High Court Dismisses Plea To Quash Charges

The accused was charged under sections 354A (sexual harassment) and 509 (insulting the modesty of a woman) of the IPC, as well as section 120(o) of the Kerala Police Act, which pertains to causing nuisance through undesirable communication. In his defense, the accused argued that commenting on a person’s “nice body structure” does not qualify as a sexually coloured remark under these legal provisions.

However, the prosecution and the complainant refuted this claim, asserting that the accused’s messages and calls had sexually explicit undertones. They argued that the remarks were not casual but intended to outrage the complainant’s modesty and subject her to continuous harassment.

Justice Badharudeen agreed with the prosecution’s perspective, stating that the allegations, prima facie, satisfied the requirements of the offences outlined under the IPC and Kerala Police Act. He noted, “Having noticed the facts of the case, it is discernible that the prosecution case is specifically made out, prima facie, to attract the offences alleged to be committed.”

The court dismissed the accused’s plea, stating, “In the result, this Criminal Miscellaneous Case stands dismissed. Interim order, already granted, shall stand vacated.”
